Supreme Court Rules Cities May Seize Homes and Businesses

A divided Supreme Court ruled today that local governments may seize people's homes and businesses against their will for private development.
Supreme Court Justice Sandra Day O'Connor wrote: "Any property may now be taken for the benefit of another private party, but the fallout from this decision will not be random," she wrote. "The beneficiaries are likely to be those citizens with disproportionate influence and power in the political process, including large corporations and development firms."
This ruling makes it imperative that we move forward with getting signatures for Yorba Linda RIGHT-TO-VOTE Initiative as soon as possible.
The City will no doubt move forward at a quicker pace in light of this decision. They are already trying to move the EIR (Environmental Impact Report) process for the proposed PD (Planned Development) zoning regulations forward even though they have not approved the developers concept plan.
They know that once high-density zoning is in place it can be used by the developer to build a high-density development.
