YORBA LINDA – Attorneys for City Clerk Kathie Mendoza have filed papers asking an Orange County Superior Court judge to invalidate the Right-to-Vote initiative and remove it from the June 6 ballot.
The initiative, put together by the Yorba Linda Residents for Responsible Redevelopment, seeks to give voters final say over major land developments that require changes to key city planning documents.
The legal papers repeat Mendoza’s September assertion that the initiative petition was flawed because it did not include the full text of the city’s general plan and other documents affected by its passage.
The papers name the Orange County Registrar of Voters and the Yorba Linda City Council. The council certified the initiative with the expectation that it would be challenged.
Also named as “parties of interest” were the initiative’s sponsors – residents Jeffrey L. Winter, James E. Horton and Dennis P. Wilson.
"They haven't served me yet," Winter said Thursday. "I am sure that the city is doing everything they can to invalidate the vote."
The community group is now working on a referendum that seeks to block the building limits from becoming law.
